一般取引条件は、ウェブサイトを通じてお客様が購入したKENZO製品に関するお客様のすべての注文に適用されます。

一般取引条件は、ウェブサイトからいつでもアクセス可能であり、電子版または印刷版を保管することができます。

一般取引条件は、ウェブサイトに掲載されている限り有効です。

お客様は、本ウェブサイトを通じて注文を行うことにより、注文に先立ち一般取引条件を読み、一般取引条件ならびにウェブサイトの個人情報保護方針および利用規約を無条件で受け入れることに同意したものとみなされます。

一般取引条件は、リンク、バナーその他のハイパーテキストリンクによりウェブサイトに表示されているサービスや製品であっても、、KENZO以外の企業によるサービスの提供または製品の販売には適用されません。KENZO以外の企業から製品またはサービスを注文、あるいは購入する場合は、当該企業が適用する取引条件をご確認ください。KENZOは、第三者によるサービスの提供または製品の販売については責任を負わないものとします。 

当社の個人情報の取扱いに関する個人情報保護方針を参照してください。

当社のウェブサイトにおける購入については、付加価値税の返金を行いません。 

ご注文のKENZO製品には請求書が同封されます。

当社は、ウェブサイトの価格が正確であるよう細心の注意を払っていますが、万一当社側で誤りがあった場合、適用法に従った上で、表示価格が明らかに誤っている場合、KENZO製品を提供しない権利を留保します。

当社は、いつでも予告なくウェブサイトに表示された価格を変更する権利を有します。ただし、変更された価格は価格変更後に行われた新規注文にのみ適用され、すでに行われた注文の価格には影響しません。

KENZO製品をEU内に配送する場合には、関税は発生しません。

EU外では、国によって関税および輸入税が課されます。各国の関税当局は、以下を含む様々な要因にもとづき、関税および税金を計算します。
-    国際統計品目番号（HS）システムにおいてKENZO製品が分類されるカテゴリ
-    KENZO製品の価額（お客様の支払額を基準とします）
-    多くの国では関税は「CIF」（運賃保険料込）で計算され、お客様が支払う配送料は関税額の計算にあたり考慮されます。

お客様の注文の合計金額には以下が含まれます。
-    KENZO製品の購入価格（全ての適用される地方税および手数料を含みます）
-    該当する場合、関税、輸入税、通関手数料（当社のサービスプロバイダであるフランスの会社、Glopal、本社所在地：1501 Routes des Dolines - Le Thélème - 06560 Valbonne, France、Grasse商業登記簿の登記番号501 2016 071、により計算）
-    配送料は、お客様が配送先住所を記入し、配送方法を選択してから計算されます。

KENZO製品および海外配送料の支払いは、チェックアウト時に一括で行われます。

税金および関税が事前に計算され支払われる国については、原則として税関書類を記入する必要がなく、支払い金額が変動することはありません。お客様の国の税関当局により実際に課される税金および関税は、様々な理由によりお客様が支払った金額から上下する場合があることにご留意ください。例えば、特定の税関により、お客様の購入製品が、Glopalが使用するカテゴリとは異なる統計品目番号のカテゴリに分類されたり、お客様の国の税関当局が、（理由の如何を問わず）関税額を計算するために異なる計算式を利用したり、計算が当社の計算時と税金および関税の税関当局への支払い時との為替レートの差異により影響を受けたりする場合があります。このような場合、お客様に対する返金（実際の金額が少ない場合）、または追加課金（実際の金額が多い場合）は行われません。これは、そのような手続きの実行には、時間や費用がかかるためです。

KENZO製品の所有権は、購入価格の全額が支払われるまでは移転しません。

一方、損失の危険は、KENZO製品の配達時、つまりお客様が指定した配送先住所において、KENZO製品が引き渡された時点で移転します。
 

If you are not happy with KENZO Products, you can return them free of charge and receive a refund in the frame of your right of withdrawal/cancellation. However, we do not exchange items.

You have a period of fourteen (14) days to exercise your right of withdrawal/cancellation, without having to justify your decision, under the conditions of article L221-18 and seq of the French Consumer Code, if it meets the conditions laid out in these provisions.

This period starts from the moment the KENZO Products are received by you or a third party designated by you (other than the carrier). If your order contains several Products delivered separately, this period will start when you take possession of the last Product delivered.

If the fourteen (14) day period expires on a Saturday, a Sunday or a public holiday, it will be extended to the following working day.

Only you, as buyer, can exercise this right of withdrawal/cancellation. It should be noted that, in the case of a gift, the right of withdrawal/cancellation is for the sole benefit of the customer (buyer) and cannot be exercised by the gift’s beneficiary. Furthermore, in accordance with Article L221-28 of the French Consumer Code, you are informed that the right of withdrawal/cancellation cannot be exercised (i) for orders of goods made according to the consumer's specifications or for goods that have clearly been personalized and (ii) for goods which have been unsealed by the consumer after delivery and which cannot be returned for hygiene or health reasons.

If you have benefited from a promotional offer on the E-shop, entitling you, under certain conditions, to one or more free products in exchange for your Order, and if, as a result of exercising your right of withdrawal/cancellation, you are no longer eligible for the offer, you must return the Product(s) you wish to return together with the free product(s) received when benefitting to the promotional offer. 

Similarly, when returning a Products which contains an accessory, the return will only be valid if the returned Product is returned intact with its accessory, also intact.

To return a Product, on our E-shop, go "My Account" and select "My Orders", then:
1. Choose the relevant order number and select "create a return".
2. Follow the steps indicated to finalize your return.
3. Print the prepaid return label and affix it to your package. This label will contain details for processing your order and will release you from having to pay shipping costs.
4. Choose a DHL collection point near you. You can also contact our Customer Service or DHL Express directly to arrange for your parcel to be collected from your home.

You can also inform us of your decision to withdraw by using the withdrawal/cancellation form at the bottom of these General Terms and Conditions of Sale, or any other unambiguous statement expressing your wish to withdraw. This request can be sent to the Customer Service by email at the following address: customerservice@kenzo.com.

You have fourteen (14) days from the date of your request to return the Products to us.

You must return the Products to us complete (including any accessories or gifts included at the time of purchase, instructions, product label, etc.) in their original condition and packaging, with the prepaid return label. This prepaid label can only be used when shipping from the original country of delivery. Products cannot be returned or refunded at stores.
To keep proof of this return, we advise you to keep the copy of the return tracking number and of the shipping label validated by the shipping company that provides the specific date of your delivery.

KENZO will refund the returned Products at the price invoiced (including delivery costs and taxes unless the return is only partial), under the conditions of article L221-24 of the French Consumer Code, according to the initial payment method used, within a maximum period of fourteen (14) days following receipt by KENZO of the returned Products or following the date on which you provided proof of the Products having been shipped, whichever comes first.

By virtue of Article L221-23 of the French Consumer Code, the consumer can only be held liable in the event of depreciation of the goods as a result of handling other than that strictly necessary to establish the nature, characteristics and correct functioning of these goods. In this context, any Product returned incomplete, damaged, deteriorated, soiled or in any other condition that might reasonably suggest that they have been used or worn, will not be refunded and will be returned to you.

Any additional costs paid by the customer as a result of the choice of a specific delivery method will not be refunded.
If your returned Products are validated, a confirmation email will be sent to you.

Concerning the purchase of E-Gift Cards, the conditions of the buyer's right of withdrawal/cancellation are specified below in Article 11. 

お客様は、配達された KENZO  製品がお客様の注文に一致していることを確認しなければなりません。配達された  KENZO 製品が注文と一致しない場合、カスタマーサービスチームに電話またはメールで連絡し（連絡先は「請求情報」の項を参照）、「キャンセル、返品」の項に定める規定に従って対象製品を返品してください。

配達された KENZO 製品に付属する保証規定にかかわらず、本ウェブサイトで販売されるKENZO 製品は、フランス消費者法 L.211-4、L.211-5、L.211-7 および L.211-12 に定める法定保証の対象となります。従って、製品が意図された使用に適さない場合、KENZO 製品の配達後2 年間この保証を利用することができます。なお、KENZO 製品の配達から 1 年以内に出現した不適合は、配達時に存在していたものと推定されます。不適合の場合、当社は KENZO  製品を交換し、交換が不可能な場合にはお客様の注文全額を返金します。

また、本ウェブサイトで販売される KENZO 製品は、フランス民法第 1641 条および第 1648 条に定める隠れた瑕疵に対する保証の対象ともなります。従って、製品が意図された用途に不適合である場合、瑕疵を発見後 2 年間、本保証を請求することができます。目に見えない欠陥があった場合、当社はKENZO製品を交換し、交換が不可能な場合にはお客様の注文全額を返金します。

当社の義務の全部または一部の履行は、履行を妨げる、あるいは遅延する事故、もしくは自然災害の場合には停止されます。
 

11 – SPECIFIC CONDITIONS APPLICABLE TO KENZO E-GIFT CARDS 

• How to purchase a Kenzo E-Gift Card? 

The KENZO gift card can be purchased exclusively on the E-shop, and only in the following Eurozone countries: Germany, Austria, Belgium, Cyprus, Croatia, Spain, Estonia, Finland, France, Greece, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Portugal, Slovakia, Slovenia. 

The purchase is limited to a single E-Gift Card per order and cannot be combined with other Products in the same basket. 

The E-Gift Card can only be credited by the buyer once during its purchase. It is not rechargeable by the buyer or the beneficiary. 

During the purchase process, the buyer must complete the mandatory fields on the order form. This data will be processed in accordance with KENZO's Personal Data Protection Policy.  

The buyer can choose the value of the Kenzo E-Gift Card to be credited from the amounts offered by KENZO on the E-shop, namely: €50, €150, €250, €500 or €800. No fees will be applied to these amounts. 

The E-Gift Card can be paid for with all payment methods accepted on the E-shop, with the exception of another E-Gift Card. 

When ordering, the buyer can write a personal message for the beneficiary of up to 200 characters, which will appear in the email accompanying the E-Gift Card. KENZO is not responsible for the content of this message. The message must not under any circumstances: 

• Violate the intellectual property rights of third parties; 

• Infringe the laws in force in France or the country of purchase; 

• Contain defamatory, insulting or threatening language; 

• Include obscene or pedo-pornographic elements; 

• Contain sensitive personal data. 

Once the payment has been finalized and the order confirmed, the E-Gift Card is issued and sent by email to the buyer, to the email address mentioned when ordering. The E-Gift Card will also be sent to the beneficiary at the email address provided when ordering. In this regard, the buyer declares and guarantees KENZO that they are authorized to communicate the beneficiary's email. 

It is not possible to send the E-Gift Card at a later date. 

• What is the period of validity of a Kenzo E-Gift Card? 

The E-Gift Card is valid for a period of three (3) years from the date of purchase. 

The expiry date is mentioned in the email containing the E-Gift Card and can be consulted at any time on the "View my E-Gift Card" page. 

After this period, the E-Gift Card can no longer be used. 

Upon expiration of the validity date, the remaining balance will no longer be usable or refundable, unless legally required by the applicable law in the country where the E-Gift Card was purchased.  

If your E-Gift Card needs to be re-credited by KENZO as part of your right of withdrawal or a legal guarantee, for a Product purchased with an E-Gift Card before its expiry date, the expiry date of your E-Gift Card will be extended for a period of 60 days from its initial expiry date.  

• How to use the Kenzo E-Gift Card? 

The E-Gift Card is activated upon sending and can then be used directly as a payment method, exclusively on the E-shop of the country where it was purchased. For example, if you purchase your E-Gift Card on the France E-shop, it will only be usable on the France E-shop. Therefore, the E-Gift Card cannot be used in an E-shop country different from the country of purchase on the E-shop. For example, if you purchase your E-Gift Card on the FranceE-shop, your E-Gift Card will not be usable on the Italy E-shop. 

Without limitation, the E-Gift Card is also not usable in physical stores, outlets, corners in department stores and other e-commerce sites. The E-Gift Card can be used to purchase all Products offered on the E-shop, with the exception of the purchase of another E-Gift Card. 

The beneficiary can use the E-Gift Card once or several times, within the limit of one E-Gift Card per order, and within the limit of the available balance. Indeed, it is not possible to use several E-Gift Cards to pay for the same order. 

The E-Gift Card can then be used by entering its unique code appearing on the E-Gift Card issued in the field provided for this purpose during payment on the E-shop. 

If the order amount exceeds the balance available on the E-Gift Card, the difference must be paid by another payment method accepted by KENZO on the E-shop, in accordance with Article 6 above. 

With each use, the order amount is debited at the time of the order and will be automatically deducted from the balance of the E-Gift Card used. If the order amount is less than the balance, the remaining balance will remain available until it is used or until the end of the E-Gift Card's validity. Once the balance has been used in full, the E-Gift Card is unusable and cannot be reloaded. 

The E-Gift Card is not nominative. It cannot be exchanged for cash, nor can it be the subject of an exchange or a refund, even partial, or any monetary compensation or reduction, in case of loss, theft, damage, or expiration. This rule applies subject to the buyer's right of withdrawal and any mandatory legal provisions, if applicable, in the country of purchase. 

In the event of Product return in application of Article 9 above: 

• If the payment was made solely with the E-Gift Card, the refund will be made to the E-Gift Card used for the purchase. 

• In the event of payment with an E-Gift Card and another payment method, the refund will be made as a priority to the payment method other than the E-Gift Card used, up to the limit of the amount debited at the time of purchase. The remaining amount due, if any, will be refunded to the E-Gift Card. 

The buyer and the beneficiary are responsible for the security, confidentiality and storage of the E-Gift Card, in particular the code associated with it. 

Without prejudice to the legal guarantees applicable, and except in the event of gross negligence or willful misconduct on the part of KENZO, KENZO declines all responsibility: in the event of loss, theft, damage or unauthorized use of an E-Gift Card by a third party, or even in the event of non-receipt of the E-Gift Card in the event of an invalid email address, saturated email boxes, firewall or anti-spam filter of the buyer or the beneficiary. 

• Buyer's right of withdrawal after purchasing a Kenzo E-Gift Card 

In accordance with the provisions of Article L.221-18 of the Consumer Code, the buyer has a right of withdrawal that he/she can exercise within fourteen (14) days from the date of the buyer's receipt of the E-Gift Card, as evidenced by the sending of the e-mail containing the E-Gift Card to the address provided during the purchase, provided that the E-Gift Card has not been used in part or in whole before the expiry of this period. The E-Gift Card cannot be exchanged. This right cannot be exercised by the beneficiary, if the beneficiary is different from the buyer. 

The request for withdrawal relating to an E-Gift Card must be sent to KENZO Customer Service by email (customerservice@kenzo.com), or via the withdrawal form at the bottom of these General Terms and Conditions of Sale, or by any other unambiguous statement expressing this wish to withdraw, indicating the order number. 

• How to find out the balance of a Kenzo E-Gift Card? 

The balance of the E-Gift Card is available on the "View my E-Gift Card" page, by entering the code associated with your E-Gift Card, appearing on the E-Gift Card. 

KENZO reserves the right to correct the balance of the E-Gift Card if KENZO believes that an administrative, billing or accounting error has occurred.

これらの商標、イラスト、ビジュアルおよびロゴの全部または一部の複製、修正、使用は、理由の如何を問わず、いかなる通信サポートにおいても、厳重に禁じられています。

If one or more provisions of these General Terms and Conditions of Sale are declared null and void or deemed unwritten pursuant to a law, regulation, or a final decision by a competent court, the other provisions shall retaintheir full force and effect. 

13.1 当社の一般取引条件は、フランス法に準拠します。一般取引条件はフランス語で作成されており、他言語に翻訳されている場合、争いがあるときはフランス語版が優先するものとします。

13.2 紛争が生じた場合、お客様は訴訟に先立ち、従来の調停または他の代替的紛争解決手段による友好的解決を求めることができます。

13.3本一般取引条件のもとで、その有効性、解釈、履行、終了、または各種帰結に関して生じるあらゆる紛争は、フランスの裁判所の管轄とします。
